The Regretsy Double Douchebag Award

- Submitted anonymously

Congratulations to Etsy seller Bohemian Smile for receiving the coveted Regretsy Double Douchebag Award!

Not only are they ripping off artist Ron Burns…

They’re ripping off animal shelters too!

Not the plagiarized Ron Burns art you were looking for?

How about Sad Doggie?

Of course, Ron calls his version Toby. But at least Bohemian Smile came up with their own name!

Maybe you prefer Take Me Home.

Sorry! I meant Otis.

Not in the mood for a stolen Burns? How about a Vladimir Gorksy?

Or maybe a Deyaz?

Still not seeing what you want? Don’t worry! They are a very artistic couple, so they’ll paint anything!

THEY JUST HAVE TO SEE IT FIRST

UPDATE: THEY ALSO HAND MAKE LEATHER SKIRTS

I went to Cambodia this past summer and I SWEAR TO CHRIST I saw that Angkor Wat print for sale at a museum in Siem Reap. I went to their website but they don’t sell stuff online.

And those Vietnam prints are ALL OVER Vietnam. You can see them everywhere.

I’m sure they are just ‘showing a portion for editorial review’ as allowed by the copyright law.

Oooo, metaphysical question, is it plagiarism if it doesn’t sell or just bad copying?

As you can get called out for plagiarism on academic papers for which you receive no money for writing, I say it still counts.

But let’s not be narrow-minded. It could be both.

Art theft is annoying no matter what, but the fact that he supports animal shelters with the proceeds makes this especially irritating.

try the branch of the humane society as well, they may have some copyright on these too… he may have “gifted” the rights to them so they could get the proceeds directly from sales outlets. so reporting to them might work too. He takes a small write off on the donation of the works’ rights and the humane society can sell the prints all they want to save all the little friends!

(i don’t know for a fact that’s what he did, but it could be worth notifying the HS as well)

I’m really, reeeeally drunk – not normal Regretsy-browsing tipsy, but shit-faced on an entire bottle of wine (thank you, Chrome spellcheck, for making comprehension of my rant possible), and the fact I’m alternately looking at kitten pictures of my now grown cats, while browsing Etsy for (REAL) handmade Christmas gifts, I’m extra-special-furious about this particular thievery. WON’T SOMEONE PLEASE THINK OF THE CHILDR-er, cats, sad doggies, and zebras!?

Bohemian – a person, as an artist or writer, who lives and acts free of regard for conventional rules and practices.

I always get a little miffed when someone uses the term “Bohemian” incorrectly. I am Scottish and Bohemian. When they changed the name of the country my Grandfather went apeshit-”It will ALWAYS be Bohemia”!!!!!!!!!!!

Luckily, in Chicago, we have the Bohemian National Cemetery, so it’s pretty accepted that Bohemia is A) an actual place, and B) not collective of pre-emo drum beating, snap assing, bad jazz worshiping poets of dubious talent.
My great-grandmother came to Chicago from Bohemia. I don’t even have bagpipes, just rightous indignation…and mushrooms. Can’t forget the houbys.

Pft, come on, they’re not even the same paintings! I mean, there are some colour differences, and sometimes they didn’t do the greatest job at making an exact duplica– I mean, weren’t as good at being inspired, and sometimes there’s even different colours! Take that zebra, for instance. Totally different. This couple of “art painters” (you know, as opposed to us mistaking them for house painters) are so original it hurts.

It’s not infringement, it’s an homage. Yep.

Is this usually how Etsy resellers screw people?

Due to various customs regulations per country, it may occur that import levies, duties or taxes to be paid on the redemption amount, in which case the buyer is solely responsible for paying fees and or taxes. To minimize this occurrence we mark packages as low value post. Packages that have lost by during postal shipment will not be reimbursed.
They lose it and keep your money.

No, this is copying and *selling* – which is a no-no legally. Not the same thing as remixing or creating fan works that are for enjoyment/homage only and not ever meant to be sold. When you’re creating art you can be inspired by something, you can loosely base a work on something, but you can’t outright make a copy of that something, even if you do it by hand with oil paints, and then say that it’s yours to sell. The right to profit from the work belongs to the original artist.

And the Mona Lisa falls well outside the bounds of copyright, that’s why anyone can copy it and sell the copies – the Mona Lisa is in the public domain. The works of Ron Burns are not.

I understand the legality of it. I prefer Japan’s way of doing shit, is all. You can’t replicate and sell precisely the art (these examples would actually be out of line even there, and I agree with that), but anything remotely derivative is fine.

I don’t think you should own every variation of something after you set it free, any more than Disney should be able to sue a small child for drawing Mickey (which they don’t for public relations reasons, but could). American copyright law goes too far in my personal opinion.

(I realize when my opinion is not popular, however, it is likely to become hidden.) :)

Copying the Mona Lisa is a little different, since you’re not depriving da Vinci of anything. And no one is going to think you created it, because it’s an iconic work. Most people who see the zebra, for example, are not going to say, “Hey! That’s a Deyaz!”
