Flag Day: GLITTERBISCUITS
As you know, Etsy has a very strict policy against copyright infringement. And by “strict”, I mean looking down at their high tops and waiting for their milk to foam.
However, they have thoughtfully enabled jerks like us to do the work for them, by providing the option on each seller’s store where the thief can be flagged.
And that’s where you come in!
Apparently Etsy seller Glitterbiscuits (Tyneshia Buie) has been tracing a T-shirt design by artist Jess Fink, and selling it on Etsy with no shame.

I saw this last night and it really upset me. But by then Tyneshia had removed the shirt from her store, and I felt like it was too late to do anything about it. You couldn’t even really flag her at that point, because she was no longer actively engaged in doing anything wrong.
Then this was brought to my attention:
That’s the banner of her Etsy store, and she’s even using the image of the shirt.
And she’s changed her profile too:

Yes, she’s changed all her store information to say that while she’s been stealing another artist’s work, you can all go fuck yourselves. Isn’t that awesome? Meanwhile, the Etsy staff are riding their bicycles around the office and drawing mustaches on their pith helmets.
So this is what I’d like to see happen.
I’d like to see this store closed down TODAY.
I am asking all of you who are reading this, and there are hundreds and thousands of you, to flag this store right now. That might almost be enough to get Etsy’s content team to put down their copies of Catcher in the Rye and start doing their jobs.

I’m on vacation too! I know I would hate it if someone stole my artwork. There is something called a copyright law which part of states that anything posted online (words, pictures, etc.) is protected and this girl can be majorly sued over this blatant theft.

etsy would eventually catch it- they make you list all of your accounts in your profile, so i think they can see by your ip address or something.
that is how they caught “sock puppets” and disabled accounts in the forums.
i HATE that the seller shows no remorse in her actions. this is taking way from artists like myself who actually bust our asses to get sales.

@sistahsenn: I think you’re mistaken–Jess Fink is the actual creator of this design. Seeing it on zazzle doesn’t prove that she didn’t design it. In this case, it means it’s being ripped off.

The Fink t-shirt has been for sale for a *long* time on threadless and has been copied many times, but that still doesn’t make it okay – and this wench is *admitting* to copying *this specific artist* so… it isn’t like we’re even making this up.

This is a very old conversation and I can’t believe I’m answering, but everyone who has responded to you that I’ve read so far is wrong. Copyright don’t cost a goddamned thing. It’s free. When you create something, you have the copyright to it, automatically, under U.S. law. When you pay the $30-$40 (I forget exactly) to register it with the Copyright Office, what you’re paying for is the right to sue the infringer for even more money than they’d normally be fined under copyright law. But that’s all. If you can prove you made it first, that’s all you need for the minimum punishment.
Just thought I’d throw that out there in case it wasn’t already said ’cause I’m gonna back away now and go back to reading through the archives again like I have nothing better to do. Meh.

Copyright law is confusing & there are lots of myths about it. It definitely does NOT cost $10,000/piece. The originator of a piece of art automatically holds its copyright, which he or she can then register (in the U.S.) at http://www.copyright.gov for $35. Even if a copyright is registered, defending it takes a lot of time, effort & resources. Definitely not cool to be copying & profiting from a small-time t-shirt artist’s work, whether on Etsy or on Zazzle. Not sure how effective this campaign will be, though, since Etsy specifies that flagging is not meant for intellectual property matters: http://www.etsy.com/policy/dosdonts#flagging

Ummm…excuse me sir, I believe you’re thinking of TRADEMARKS. Copyright does not cost a thing, so she could possibly sue to stop this young lady copying her work.
The only stumbling block would be how many she made, as in some jurisdictions it’s not considered a copyright-able artwork if it’s been ‘mass-produced’ – that’s why Target can make blatent copies of high fashion label items.
I would still initiate proceedings against her though, to scare her off continuing to do this stuff.

Dear, a copyright does not cost $10,000. For a single work, it’s $35. And well worth the cost if you’re planning to sell items featuring your design.
That’s assuming she went through the U.S. Copyright office, of course. Creative Commons is free, though it provides somewhat less legal protection, as it was designed specifically for providing attribution on publicly shared works. (That’s what I use for my published knitting patterns.)

Smath, your understanding of copyright law is pretty poor for someone who just took a copyright class. Something being mass produced does not prevent it from being copyrighted, you know, like books. The reason stores can knock off fashion items is that there is currently no design copyright for clothes (there is one for boat hulls though!) They still have to be careful to avoid violating trademark (three stripes means Adidas sues Payless and wins, even if you claimed it was FOUR stripes and the three stripes are just the background,) and reuse of copyright protected works, as is likely the case with the drawing reproduced here.

regretfaster, I suppose you could treat the drawing as a separate ‘work’ to the actual shirt if you liked, but whether that would suceed is another matter. There is, at least where I am, an open debate about clothing as ‘art’ and whether it can fit in.
And yes, of course company symbols on items can’t be copied (because they are trademarks, not because they are copyright)
Also, I should add I studied Australian copyright law (because I’m in Australia) so there may be technical differences if this is all US-based. But it’s pretty similar for the most part because of agreements between countries.

Sistahsenn I don’t know where you’re getting your information but you could not be more wrong. Copyright has nothing to do with how long something has been around. As an artist the moment you create a piece of art work you own the copyright to that work. Period. No money needed. HOWEVER for an infringement case to hold up in court you need to register your work with the US Copyright Office which costs $35. That price can cover an entire collection of images and designs, which is what I do for my photographs every year. $35 and I’ve officially registered hundreds of images. Saying that “copyrights” cost $10,000 a piece is just laughable.

Quite frankly, my problem isn’t even the copyright issue. It’s the fact that someone drew to her attention the fact that she was copying someone. So did she apologize? No. Did she defend her actions using words similar to yours, explaining why she felt she had the right to produce the shirt? No. She got cocky, and bitchy, and obnoxious, splaying her pride at her own maliciousness all over her store. I wouldn’t have even cared that much if her initial response was a refusal to take the shirt. I would have thought it was shitty, but that’s about it.
But to jump from “I’m not going to take down my merchandise” to “HAHAHHA YEAH THAT’S RIGHT, I RIPPED YOU OFF” is so inexcusably douchey. For that reason alone, I’m glad HK brought it to my attention. If nothing else, I’ll remember to never purchase anything from her store (once I have money for Etsy).

Yup Yup Yup. Along the lines of what drunkenatheist said, I think most folks who make art in any kind of volume have had the experience of creating a piece only to realize later “OH SHIT. I totally accidentally ripped off that person.” Maybe you saw it once and didn’t consciously remember it but it stuck in your brain SOMEWHERE and you copied it w/o realizing that is what you were doing. That is not a big deal if, you know, you QUIT COPYING THE PIECE and feel bad about it. Shit happens and Googling for look-a-likes of every piece you make just to check would be a little ridiculous an ineffective.

I’ve met Jess on several occasions and we have some mutual friends — I’m aware of her previous troubles with D & G (she’s not the only one who’s had problems like that with them) and also how long she’s had the milk & cookies design. I’m glad Regretsy has screencaptured much of Glitterbiscuit’s gloating, self-incriminating behavior. I suspect whatever legal channels Jess chooses to go through will find it quite interesting.

Also, this isn’t the first time Jess has had her work stolen. Todd Goldman (David and Goliath) has stolen this design and her Soap shirt so I’m sure there’s lots of variations floating around. I’ve had this happen to a friend of mine on DeviantArt.com I’ve known for years. she went to a convention with stickers of her work. a well known art thief then bought the stickers, copied her designs for a contest, which won a significant monetary prize. then the infringed art was then printed to a t-shirt even more money went to the thief via sale profits. Not only was my friend infuriated, so was I.

I get competitors actually ripping pictures off my website and putting them on their websites claiming MY work is their’s. I used to spend huge amounts of time trying to find the thieves. Now I just let karma come and bite them in the butt…..their clients are, I am sure, disappointed in what it is they wind up getting.
But taking someone else’s idea is WRONG. Bragging about it is really bad. I would never want that kind of karmatic synergy flowing against me. That’s the kind of stuff that causes asteroids to fall on your happy ass.

I have been an avid reader of your blog for a few months now, and I absolutely love it! When I saw this post, it made me very annoyed. So I went right over to Etsy.com and made a login name JUST to complain. Here’s what I briefly stated.
“This user is blatanly ripping off her cookies and milk t-shirts from another person. I just signed up for this site, and I am not impressed with the fact that you have sellers on here with no original talent for their own. Very disappointing.”
Hopefully that rotten bitch will be shut down by the end of the day!

Ugh. This is almost as sad as that terrible seller: that so many people have created Etsy accounts today for such a negative reason. Of course there is stuff on there that is laughable… but there are also many talented artists and serious crafts people who have studied and sacrificed for their talent. I hope that some of you will eventually take the time to find these other sellers and support what they do.

I bought some great letterpress calendars on Etsy, and before that I found a vintage (1940s) Christmas card that was sent by a friend’s famous cousin.
I encourage everyone who signed up for Etsy today to buy something they genuinely like. It might be classy and elegant, or some of the whimsicle fuckery from sellers who have been featured here. Support people who make quality items.
That was such a great sentiment that I tweeted and Facebooked it. Thank you for posting that, and I hope a lot of sales come as a result. – HK

Unfortunately, my issues are with Etsy itself, not the bad sellers on it. I can’t justify giving my money to the Etsy company even if the sellers using their service benefit.
And that’s if Etsy would let me sign up again; they yanked my account for being loud in the forums and for daring to mention that Etsy wasn’t my only online selling venue.
So typical of Etsy – being quick to take down stores of legitimate sellers who criticize them, but letting resellers and thieves stay up as long as they like.

Yup. It is sad, indeed. Another downside to this is that it’s feeding Etsy a bunch of new registrations and page clicks that they’ll be able to show off to the investors. I hope Ms. Fink goes after her with a lawyer, because I don’t think shutting down her Etsy shop would have any sort of impact on her at all, and she’s probably relishing the extra attention.

Why would I waste my time doing something like that? Instead, I contacted Jess directly and told her to file suit. She’s the owner, she’s the one with the right to bring the other person to court. With the information provided by the thief themselves, I don’t doubt Jess would have a pretty open-shut case in her favour. At least it’s an option better than flagging, IMO.

You have a point that a lawsuit might be more effective. However, Jess and other indie artists get their designs stolen all the time, not only by two-bit assholes at flea markets but by huge companies. It’s easy to steal a design, but it’s expensive and time-consuming to sue the thief.
Fink vs. Glitterthief might be a quick case. But David & Goliath, Forever 21, and all the other huge companies who ALSO rip off designs are tougher nuts to crack. They’re clearly in the wrong, but they clearly have huge legal teams at their disposal, because they keep getting away with it. Jess could spend a life’s worth of time and money chasing every thieving bastard and get nowhere.
Sadly, angry mobs often get shit done a lot more effectively than going the “correct” route. And I’m happy to do even a small part for any honest independent artist who wants help.

See, cease and desist orders to huge companies who rip off indie artists are like rain running off a duck’s back.
A big pool may form behind it, but Duckie will not be affected.
Also, they get past infringement by subtly or not-so-subtly changing the original artist’s design.
That way, they can claim that the indie artist is mistaken, and it’s just a coincidence that there’s any resemblance.
glitterbiscuits didn’t do that – SHE FLAT-OUT TRACED IT.
And Etsy is claiming that our reporting isn’t the way to address copyright infringement.
30,000+ reports down the drain. Etsy will give her their blessing to set up shop as many times as she wants.
The only to put the bite on them both is to include them BOTH in a LAWSUIT.
SUING FOR COPYRIGHT INFRINGEMENT IS PERSONAL-only Fink/Threadless can do it.
Until that happens, NOTHING WILL CHANGE.

Then the thread was closed, but obviously nothing was done about the shop. Words cannot describe how angry that makes me. THIS IS WHY I HEART REGRETSY WAY MORE THAN ETSY.

The “calling out” rule is the main reason I never posted on the forums. There’s a difference between degrading someone’s work, and pointing out a reseller. The latter should not only be allowed, but encouraged. But then, etsy would have to cop to the fact that everything being reported ends up in the circular file.

If you read it, they also demand the signature of the person who owns the copyright:
1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright or intellectual property right that has been allegedly infringed upon (by fax or regular mail – not by email, except by prior agreement)
There you have it. They do not care about copyright infringement and do not care to act upon it unless the owner of the infringement informs them of it. They don’t desire to stop people from infringing, but they will if the *right* person complains.

I don’t shop Etsy much unless I’m looking for something in particular (mostly hand dyed yarns), and I’ve seen enough douchebaggery in that with people selling commercial yarns or ‘recycled’ which really just equates yarn they ripped out from a Goodwill sweater.
I didn’t really realize the entire extent of Etsy’s ridiculousness until I started reading Regretsy. And since then my appreciation of Etsy as a ‘handmade’ resource has consistently declined to the point where I’m really considering deleting my Etsy account. It’s becoming really difficult for me to really even believe that ANYTHING posted on Etsy is handmade and/or original.
